2. The Services

YapaneseAI provides tools and content for learning Japanese, including lessons, vocabulary, kana and grammar practice, graded reading, scripted dialogues, journaling, messaging, and voice conversations with AI language tutors. Features may change as we improve the Services.

Some features may require an account, an internet connection, a compatible device, or a current version of the app.

3. Eligibility and accounts

You must be legally capable of agreeing to these Terms. If you are under the age of majority where you live, you may use the Services only with the involvement and permission of a parent or legal guardian.

If you create an account, you must provide accurate information, keep your login details secure, and promptly tell us if you believe your account has been accessed without permission. You are responsible for activity carried out through your account.

4. AI learning features

AI tutors, pronunciation feedback, grammar feedback, translations, corrections, and other generated responses are learning aids, not guaranteed facts or professional advice. AI output can be wrong, incomplete, misleading, or insensitive to context and nuance.

Do not rely on the Services for medical, legal, financial, safety, or other decisions where an error could cause harm. Review important information with a qualified person or authoritative source.

5. Your content

You may provide text, journal entries, messages, voice recordings, feedback, or other material while using the Services (“Your Content”). You retain ownership of Your Content.

You grant Kaizenic Ai a limited, non-exclusive, worldwide licence to host, process, reproduce, and transmit Your Content only as needed to operate, secure, maintain, and improve the Services and provide the features you request. We will handle personal information as described in our Privacy Notice.

You must have the rights and permissions needed to provide Your Content. Do not submit another person’s private information, confidential information, or copyrighted material unless you are authorised to do so.

6. Acceptable use

You must not use the Services to:

• break the law, deceive, harass, threaten, or harm another person;
• probe, scan, attack, or gain unauthorised access to the Services;
• upload malware or interfere with the security or operation of the Services;
• scrape, crawl, systematically copy, or create a competing dataset or service from our content;
• reverse engineer, decompile, modify, or bypass limits or safeguards in the app; or
• use AI features to generate or distribute harmful, unlawful, or infringing material.

7. Our content and app licence

The Services, including their software, design, branding, lessons, examples, illustrations, audio, and other content, belong to Kaizenic Ai or our licensors. All rights not expressly granted remain reserved.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Services for their intended purpose. You may not sell, redistribute, publicly reproduce, or commercially exploit our content without written permission.

8. Purchases and subscriptions

If we offer paid features, subscriptions, trials, or in-app purchases, the price, renewal, cancellation, and refund terms shown at the time of purchase will apply. Purchases made through Apple or Google may be subject to that platform’s payment and refund rules.

You are responsible for reviewing the purchase details before confirming a transaction. We will not describe a paid feature as free or a free trial as permanent access.

9. App-store terms

If you download the app through Apple’s App Store or Google Play, your use is also subject to the applicable platform terms. Apple and Google are not responsible for providing support or maintenance for the app unless their own terms require it.

These Terms are between you and Kaizenic Ai, not Apple or Google. Any platform-specific rights or restrictions that apply to your download remain in effect.

10. Third-party services

The Services may rely on or link to third-party services, such as app stores, hosting providers, analytics services, email services, AI providers, and payment providers. Those services have their own terms and privacy notices. We are not responsible for the availability, content, security, or practices of third parties.

11. Availability and changes

We may update, suspend, restrict, or discontinue all or part of the Services. We do not guarantee uninterrupted, error-free, secure, or permanently available access. Temporary interruptions may result from maintenance, technical failures, third-party services, connectivity issues, or events outside our reasonable control.

12. Disclaimers and liability

To the extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. We do not make warranties that the Services will meet your requirements, remain available, or always contain accurate or current information.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, intentional misconduct, or rights protected by applicable consumer law. Subject to that, Kaizenic Ai will not be liable for indirect, incidental, consequential, or special loss arising from your use of, or inability to use, the Services.

13. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access where reasonably necessary to protect the Services, users, or our rights, or where you materially breach these Terms or applicable law.

Provisions that by their nature should continue after termination, including intellectual property, disclaimers, liability limits, and dispute provisions, will continue to apply.

14. Changes and governing law

We may update these Terms when the Services, our practices, or applicable requirements change. We will post the revised version with a new effective date. Continued use of the Services after the effective date means that you accept the revised Terms.

These Terms are governed by the laws of the Republic of South Africa, unless applicable law requires otherwise. Disputes will be subject to the jurisdiction of courts legally competent to hear them.
